AI Terms Matter: Backlash Against Adobe Creative Suite Licensing Terms Continues
Adobe, a giant in the creative software industry, recently updated its terms of service for Creative Cloud, sparking widespread backlash from users and design agencies alike. The updated terms, which govern popular applications like Photoshop, Illustrator, and Premiere Pro, have raised concerns about user content ownership and Adobe’s rights to utilize that content for AI and machine learning purposes.
Adobe’s terms create a firestorm of Protest
At the heart of the controversy lies section 4.2 of Adobe’s terms and conditions (see below).
4.2 Licenses to Your Content. Solely for the purposes of operating or improving the Services and Software, you grant us a non-exclusive, worldwide, royalty-free sublicensable, license, to use, reproduce, publicly display, distribute, modify, create derivative works based on, publicly perform, and translate the Content. For example, we may sublicense our right to the Content to our service providers or to other users to allow the Services and Software to operate as intended, such as enabling you to share photos with others. Separately, section 4.6 (Feedback) below covers any Feedback that you provide to us.
This clause grants Adobe a broad license to access and analyze user content for product improvement and development. While Adobe claims this is intended to enhance user experiences, critics argue that it gives the company excessive control over personal creations, potentially using them to train AI models without explicit consent.
The backlash has been fierce and many prominent firms have called for users to cancel Adobe:
I just cancelled my Adobe licence after many years as a customer.
The new terms give Adobe “worldwide royalty-free licence to reproduce, display, distribute” or do whatever they want with any content I produce using their software.
