Tech Providers: If You Don’t Want AI Regulation, Regulate Yourself Better
The regulatory landscape for AI is rapidly evolving across various levels of government.
At the federal level, the U.S. has yet to implement comprehensive AI legislation, although several bills are under consideration. In addition, the United States Executive Branch released a 64-page executive order titled “Executive Order on the Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence.”
Meanwhile, states like California are taking the initiative with laws aimed at safeguarding consumer privacy and addressing algorithmic bias.
Internationally, the European Union is leading the charge with its ambitious AI Act, which proposes a risk-based framework for regulating AI systems.
Balancing Innovation and Protection
The primary purpose of AI regulation is to strike a delicate balance between fostering innovation and protecting the public from potential harm.
Very real concerns continue to emerge about AI’s potential for misuse, such as deepfakes, discriminatory algorithms, and job displacement, which have spurred policymakers to take action.
The overarching goal is to ensure that AI is developed and deployed responsibly, ethically, and transparently.
Tech Providers’ Responses
Many technology providers express concerns about the potential for stifling innovation and hindering the development of new AI applications. They argue that the regulatory burden could disproportionately affect smaller companies and startups, impeding their ability to compete in the AI space.
Some also argue that international regulatory efforts are intended to stifle international competition. In addition, they argue that current definitions are too broad, and unclear capturing a wider range of AI systems than intended.
Consortiums and Nonprofits such as Partnership on AI and The Trustworthy & Responsible AI Network (TRAIN) have embraced the call for greater accountability and transparency, advocating for self-regulation and industry-led initiatives.
Challenges of Government Regulation: Keeping Pace with a Fast-Moving Target
Government efforts to regulate AI face significant hurdles. The rapid pace of technological advancement makes it difficult for policymakers to keep up with the latest developments and anticipate future risks.
Some argue that the government doesn’t have the resources, knowledge and business models to provide adequate regulatory oversight without derailing the advancements in AI.
However, it is important to note that government bodies may not have the immediate skills but can develop skills when needed – take for example the Nuclear Regulatory Commission
Additionally, the global nature of the tech industry complicates enforcement and raises concerns about regulatory arbitrage.
The Path to Self-Regulation
If tech providers want to avoid or reduce government intervention, they need to demonstrate a genuine commitment to responsible AI development and deployment. This includes:
- Establishing robust internal governance frameworks that prioritize ethical considerations throughout the AI lifecycle.
- Conducting thorough impact assessments to identify and mitigate potential risks before deploying AI systems.
- Providing greater transparency into AI algorithms and decision-making processes.
- Investing in research and development to address bias and ensure fairness in AI systems.
- Engaging in open dialogue with policymakers and stakeholders to shape responsible AI regulation.

The era of unregulated AI is quickly coming to an end. If tech providers don’t take proactive steps to regulate themselves and provide transparency, they risk facing a patchwork of restrictive government AI regulations that could hinder innovation and growth.
The time for responsible AI development is now. Tech companies must embrace their role in shaping the future of AI in a way that benefits both society and the industry itself.
